Terms of Use

These Terms of Use ("Terms") govern your access to and use of Vysota, including the mobile app, backend services, and related pages (collectively, the "Service"). By using Vysota, you agree to these Terms. If you do not agree, do not use the Service.

1. What Vysota Does

Vysota turns your activity data, such as steps and climbed floors, into virtual mountain progress. The Service is designed for motivation, progress tracking, and entertainment.

2. Not Medical Advice

Vysota is not a medical device and does not provide medical, health, diagnosis, treatment, emergency, or safety advice. Activity calculations, elevation estimates, achievements, and progress indicators may be incomplete or inaccurate. Always use your own judgment, follow applicable safety rules, and consult a qualified healthcare professional before making health or fitness decisions.

3. Eligibility

You must be at least 13 years old to use Vysota. If the law where you live requires a higher age for consent to digital services, you must meet that age or use the Service only with valid parent or guardian consent.

4. Your Account

You can use Vysota's core app features locally on your device without creating or signing in to a Vysota account. Account creation is optional, but account-based features such as cloud sync, account security, and support workflows may require sign-in.

The current iOS App Store version is free and does not offer in-app purchases, subscriptions, external payment links, or paid feature access. The Android version may offer optional Premium subscriptions through Google Play. Android Premium purchase and restore are handled through the Google Play account used for purchase and do not require creating a Vysota account. Android Premium does not unlock anything in the current iOS App Store version because the current iOS version includes all available features at no charge.

If you choose to create or use an account, you may use email/password, Google Sign-In, or Sign in with Apple where available. You are responsible for keeping your account credentials secure and for activity under your account. Contact us promptly at support@vysota.net if you believe your account has been compromised.

5. Health Permissions

HealthKit and Health Connect access is optional and controlled by your explicit in-app consent and device permissions. If you grant access, Vysota may read steps and floors climbed as described in the Privacy Policy to calculate app progress. You can withdraw Vysota health sync consent in the app and revoke system permission at any time in device settings, but revocation may reduce or disable health-based features.

6. User Content and Manual Entries

You may enter profile names, manual activity entries, notes, camp names, and other app data. You are responsible for the content you provide. Do not submit illegal, harmful, infringing, abusive, or misleading content.

8. Platform Availability and Premium Features

iOS App Store version. The current iOS App Store version of Vysota is free. It does not offer in-app purchases, subscriptions, external payment links, or paid feature access. All functionality available in the current iOS version is included at no charge. Android Premium does not unlock anything in the current iOS App Store version. If paid iOS digital features are introduced in a future version, they will be offered through Apple's In-App Purchase system and these Terms will be updated.

Android version. The Android version of Vysota may offer optional Premium subscriptions through Google Play. On Android, Premium may unlock additional mountains beyond the free Everest and K2 routes, Challenge difficulty, custom camps and waypoints, and future Premium expansions disclosed in the Android app.

Android subscription prices, billing periods, trials, renewals, and local taxes are shown by Google Play before purchase. Android subscriptions automatically renew unless canceled through your Google Play account settings before the end of the current billing period. Deleting the Vysota app or deleting your Vysota account does not by itself cancel a Google Play subscription.

You can restore Android Premium in the Android app through the Google Play account used for purchase. A Vysota account is not required to buy or restore Android Premium on the same Google Play account. If you choose to sign in and link Android Premium to a Vysota account, one Google Play subscription can be linked to one Vysota account at a time for sync, support, and transfer workflows. Refunds, cancellation timing, family sharing, billing disputes, and payment methods are handled by Google Play policies.

9. Apple App Store and Google Play Terms

If you download Vysota from the Apple App Store, Apple is not responsible for the Service, support, claims, or maintenance. Your use of the app is also subject to the Apple Media Services Terms and any applicable Apple App Store rules. Apple and Apple's subsidiaries are third-party beneficiaries of these Terms for App Store-distributed versions of the app and may enforce these Terms against you as a third-party beneficiary.

If you download Vysota from Google Play, your use of the app may also be subject to Google Play terms and policies.

10. Intellectual Property

Vysota, including its app design, software, names, logos, text, graphics, and related materials, is owned by Oleg Chevdar or its licensors and is protected by applicable intellectual property laws. These Terms do not transfer ownership of the Service to you.

11. Service Changes and Availability

We may update, change, suspend, or discontinue parts of the Service. We work to keep the Service available, but we do not guarantee uninterrupted or error-free operation.

12. Termination and Account Deletion

You may stop using Vysota at any time. You can delete your account from the app by opening Profile & Settings, tapping Delete Account, and confirming deletion. We may suspend or terminate access if you violate these Terms, create risk for other users, or create legal or security issues.

13. Disclaimers

The Service is provided "as is" and "as available." To the maximum extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, and reliability.

14. Limitation of Liability

To the maximum extent permitted by law, Vysota will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, goodwill, or business opportunities. Nothing in these Terms limits liability that cannot be limited under applicable law.
